Attorney Egons Rusanovs submitted the request to the court on Tuesday. He believes that the Prosecutor's Office has been delaying reviewing his previous request to release Calovskis.
Meanwhile, the court has confirmed to LETA that it has received the request.
The Prosecutor General's Office previously stated that when it receives official confirmation from the European Court of Human Rights (ECHR) saying that the Calovskis case will not be reviewed by December, the Prosecutor's Office will decide on the cyber-crimes suspect's release from custody.
According to law, a person that is to be extradited cannot be held in custody for more than a year. Calovskis was detained on December 4 of last year.
As reported, the Latvian government decided earlier this month to extradite the cyber-crimes suspect to the United States. However, the ECHR accepted a petition and temporarily halted extradition until the case is reviewed by the Strasbourg court.
ECHR Judge Ineta Ziemele previously said that the Calovskis case could take the ECHR up to a year to review. ''Cases that have been assigned top priority, as is the Calovskis case, take a year at the most to review,'' she said.
